Terms of Use

These Terms of Use (“Terms”) are a contract between you and J.A.N.F. DESENVOLVIMENTO DE SOFTWARE LTDA, doing business as Glash Studios (“Glash,” “we,” “us”), for your use of Klaus (the app, the website, and related services).

By creating an account or using Klaus, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use Klaus.

1. What Klaus is

Klaus is a consumer app that helps you cook with ingredients you already have. You can submit a photo, audio, or text of your fridge or pantry. We use automated systems (OpenAI) to detect ingredients and suggest recipes.

Klaus is not:

• a medical, nutrition, diet, or allergy service;
• a food-safety or freshness certification (a freshness feature may appear later; it is not part of the current service);
• a guarantee that a recipe is accurate, complete, or safe for you.

You are responsible for checking ingredients, allergens, cooking times, and whether a dish is appropriate for you.

2. Eligibility

You must be at least 13 years old. If you are under 18 (or the age of majority where you live), you may use Klaus only with a parent or guardian’s permission, and they are responsible for your use.

You must have the legal capacity to enter this contract, or your parent or guardian must accept it for you.

3. Account

You can try Klaus on a device before you create an account. Most features need an account. Sign-in is handled through Firebase Authentication (email/password or Google). We issue our own session token after we verify Firebase.

You must provide accurate information, keep your login safe, and tell us if you think someone else is using your account. You are responsible for activity under your account.

We may suspend or close an account that is unused, unsafe, or in breach of these Terms.

The app does not yet include a self-service delete-account control. Email support@glashstudios.com to ask us to close your account.

4. Plans and payment

Klaus is currently offered without in-app purchase. Limits you see in the app (including any free-scan cap) apply as shown.

We may introduce paid plans later (including a family plan). If we do, the price and terms shown in the app or store at the time you subscribe will control. Deleting the app does not cancel a store subscription.

We do not store payment card numbers.

5. Your content

You keep whatever rights you have in photos, audio, and text you submit (“User Content”).

You grant Glash a worldwide, non-exclusive, royalty-free license to host, process, and transmit User Content as needed to operate Klaus. That includes sending a kitchen photo, audio clip, or text to OpenAI to detect ingredients and generate suggestions. We do not keep the file. We keep the scan record and the ingredients we detected.

You represent that you have the right to submit the User Content, that it does not infringe someone else’s rights, and that it does not include images of children or of other people without permission. Submit pictures of food and kitchens, not people.

We may remove User Content that violates these Terms or the law.

6. Acceptable use

You agree not to:

• use Klaus for anything illegal, or to harm anyone;
• upload malware, scrape the service, or overload our systems;
• reverse engineer Klaus except where the law allows it;
• resell or commercially exploit Klaus without our written permission;
• impersonate us or anyone else;
• submit content you do not have the right to use;
• try to bypass limits or security.

We may throttle, suspend, or terminate access if you do.

7. Intellectual property

Klaus, the name, the logo, the software, catalog stickers, and our recipes and materials (other than your User Content) belong to Glash or our licensors. These Terms do not transfer ownership.

We grant you a personal, limited, revocable, non-transferable license to use Klaus for your own household cooking, for as long as we offer you access.

8. AI and accuracy

Ingredient detection and recipes are generated automatically by OpenAI. They can be wrong, incomplete, or unsuitable. Always check the actual food in front of you, labels, and allergens before you cook or eat.

We do not warrant that suggestions are original, that they will work in your kitchen, or that they meet any dietary need.

9. Third-party services

Klaus depends on third parties, including OpenAI, Firebase Authentication, Google Sign-In, Google Cloud (database), Google Gemini (catalog stickers only), PostHog, Sentry, and your device’s speech-to-text. Their outages or terms can affect Klaus. We are not responsible for third-party services we do not control.

10. Disclaimers

Klaus is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that Klaus will be uninterrupted, error-free, or that recipes or detections will be accurate or safe for you.

11. Limitation of liability

To the maximum extent permitted by law, Glash and its officers will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or the cost of substitute meals or services.

Our total liability for any claim relating to Klaus will not exceed the greater of (a) the amounts you paid us for Klaus in the 12 months before the claim, or (b) US$50.

Nothing in these Terms limits liability that cannot be limited under applicable law (including liability for fraud or for death or personal injury caused by negligence, where that limit is forbidden).

If you are a consumer, your mandatory statutory rights are not affected.

12. Indemnity

You will defend and indemnify Glash against claims that arise from your User Content or your misuse of Klaus, except to the extent we caused the claim.

13. Termination

You can stop using Klaus at any time. To ask us to close your account, email support@glashstudios.com.

We can suspend or end access if you breach these Terms, if we must do so for law or security, or if we discontinue Klaus. We will try to give reasonable notice when we can.

Sections that should survive (including 5, 7, 8, 10, 11, 12, 14, and 15) will survive.

14. Changes

We may change Klaus and these Terms. If a change is material, we will notify you in the app or by email. If you keep using Klaus after the updated Terms take effect, you accept them. If you do not agree, stop using Klaus.

15. Governing law and disputes

These Terms are governed by the laws of Brazil, without regard to conflict-of-law rules.

Courts of Alcobaça, Bahia, Brazil, have jurisdiction, except that if you are a consumer you may also bring a claim in the courts of your place of residence where the law requires it.

Mandatory consumer-protection rules of your country or U.S. state still apply if they cannot be waived.

16. General

These Terms and the Privacy Policy are the entire agreement between you and us about Klaus. If a part is unenforceable, the rest stays in force. You may not assign these Terms without our consent. We may assign them in a merger, sale, or reorganization. Our failure to enforce a term is not a waiver.
